Let me review the request situation for readers. There are two institutions involved in the present round of FOI/EIR requests: CRU and the Met Office. Phil Jones of CRU collects station data and sends his “value added” version to the Met Office, who publish the HadCRU combined land-and-ocean index and also distribute the CRUTEM series online.
I requested a copy of the “value added” version from the Met Office (marion.archer at metoffice.uk.gov) which has been refused for excuses provided in my last post. On June 25, 2009, learning that Phil Jones had sent a copy of the station data to Peter Webster of Georgia Tech, I sent a new FOI request to CRU ( david.palmer at uea.ac.uk) requesting the data in the form sent to Peter Webster. This too was refused today.
We now have a new excuse to add to our collection of excuses – each excuse seemingly more ridiculous than the previous one.
My most recent request was as follows:
Dear Mr Palmer,
Pursuant to the Environmental Information Regulations, I hereby request a copy of any digital version of the CRUTEM station data set that has been sent from CRU to Peter Webster and/or any other person at Georgia Tech between January 1, 2007 and Jun 25, 2009.

Regulation 12(1)(b) mandates that we consider the public interest in any decision to release or refuse information under Regulation 12(4). This is the first time that we’ve heard that their supposed confidentiality agreements merely restrict “further transmission to non-academics”. A couple of observations on this. I’m sure that CRU will soon receive a similar request from someone to whom this excuse does not apply.
However, aside from that, there are other troubling aspects to this refusal. If there actually are confidentiality agreements, I would expect the relevant language to be framed in terms of “academic use” as opposed to guild membership i.e. I’d be surprised if the language were framed in terms of institutional affiliation as opposed to use. I’ve published relevant articles in peer reviewed literature, acted as an IPCC reviewer, been cited in IPCC AR4, been invited to present to a NAS panel – my use of data is “academic” by any legal standard.
Secondly, over at the Met Office, they say “it cannot be determined which countries or stations data were given in confidence as records were not kept.” But over at CRU, they purport to “know” nuanced details of the contractual language of the confidentiality agreements – clauses that have the effect of justifying the refusal of the data.

I reckon that it’s our turn. We former subjects of the King should ask Georgia Tech for a copy of the confidentiality agreement so we can see just what the nuances are.
Is the data truly confidential for important reasons? Or is it confidential because they fear what it shows?
They obviously don’t believe in sharing. Which is too bad. They’re the kids on the playground all alone with a toy. And we’re the bully who wants it back!

I’m sure the reasons are important to Phil Jones, but that’s not really the standard that should be applied to publicly funded data. The reasons that seem most likely are A) releasing the data would undercut some sort of revenue he’s deriving from the data, B) he’s hiding something he doesn’t want exposed, or C) he’s afraid someone at Climate Audit or elsewhere is going to discover something which will harm him professionally.
I hope Ross McKitrick is working on a request for that data as we speak… he’s an “academic” and is also published in this field, so they’d clearly have to make up some new excuses in order to deny his request.
I’ve just send an identical request to David Palmer. I’m a UK academic by any conceivable definition, so I will be interested to see what excuse he comes up with this time.
Re Hulme 1996, as I said on the other thread I’m pretty sure this is a misprint for Hulme 1994, which is a discussion of the costs and bureaucracy involved in acquiring climate data from various countries.
This folder has a list of 288 countries/states/territories which send weather information under the WMO World Weather Watch Program. Might be useful as a reference for FOIing data in bite-size groups.
Christopher Booker of the Telegraph links to this site – someone should ring his bell and see if he’d give some publicity to Steve’s efforts.

This seems a great response, but I’m wondering about another side to this.
How does it generally work at a university or research institution when a researcher makes a binding agreement on behalf of the institution? In the real world, these kinds of agreements generally require a sign-off by upper management/company officers, so that the company knows about and can track any obligations that they have. I’ve had some low-level experience with my local state university, and every dealing that I’ve had that required a signature by a researcher also had to be signed off on by upper management as well, and once fully executed by all parties, copies were sent to each signatory and kept on file at the university.
It seems inconceivable to me that CRU or UEA or MET could be a party to a binding agreement and nobody at the institution can find a paper trail.
Or is my experience the exception?

At some point you need to quit fumbling around with these low level requests that are routinely denied and pursue the appeals process.
Steve: Submit your own FOI request and carry out your own appeal.
OK, hold on, lets think about this a bit. It seems to me that this “thing” is operating more like a general license than a simple confidentiality agreement. (A confidentiality agreement is a form of a license, but is generally more narrow in scope). Its not uncommon to license data and restrict its use for academic (as opposed to commercial) purposes. I think we should change the wording of the request. Where we had been saying “I hereby make an EIR/FOI request for any confidentiality agreements…” I think we should say: “I hereby make an EIR/FOI request for any agreements …”.
Steve: They used the term “confidentiality agreement.” Let’s stick to that. Widening the scope opens up more possible excuses. If the present language fails for some reason, we can always do it all over again with wider language
I’m in for Zimbabwe, Zaire, Angola, South Africa and Botswana.
I can predict the reply already:
“I’m sorry, but the terms and names of parties within the confidential agreement are confidential”.
I would not be surprised if the “confidentiality agreements” are entirely informal and not written down. Like when Dr. Smith passes data to Dr. Lewis with the request that he not pass it further.

Steve: please stick to a few countries at a time. Please consider the possibility that I’ve thought of obvious things.
I too would write a letter to someone except for the fact that I am a mere muggle, (non-academic), and would be far too tempted to use the data for commercial purposes, like selling it to some senator in a highway rest stop or selling it to Amy Winehouse in some dark alley.

3. a copy of the section of the confidentiality agreement that prevents or negates W.M.O. RESOLUTION 40 (Cg-XII) specifically the exchange of meteorological and related information;

How many stations are like this?
I noticed that on the list of stations Hadcrut use is Lismore (Centre St). According to the BOM (Aust) this station was closed on 31st Dec, 2003.

I confirm my data sources say likewise, Lismore (Centre St) ended in Dec 2003. The nearby airport AWS Aust #58214 was opened in 2002 and appears to be the prime location for the town of Lismore. The older Lismore (Centre St) site #058037 opened in 1884 but my modern BOM online records show it only from 1907.
This epitomises the CRU problem. If CRU start Lismore in 1884, there is a possibility that they are using data of a standard that the BOM rejected. If CRU are using data after 2003, it might be assigned to the wrong location.
Who is to know?
I’m in for Zimbabwe, Zaire, Angola, South Africa and Botswana.
That response got me thinking: They may take “Zimbabwe” and go back to 1980 and claim there’s no data before that. If you then ask for “Republic of Rhodesia” you may then get only data from 1965 to 1980. Before that, “Southern Rhodesia.” And on and on. Many nations have had odd permutations of official names, both before and after independence from various colonial powers. I wonder if that may cause issues.
I’ll take Greenland, Iceland, Ireland, New Zealand, and Thailand

This is absurd.
The Jones et. al.(1986) CRUTEMP station data homogenization
paper was largely funded by the U.S. DOE.
As such, the “data” is public domain.
All Station Data used to be posted on the Internet(1851-1994).
It mysteriously vanished some years back.
Oak Ridge National Laboratory(ORNL/CDIAC-37 NDP-020/R1):
“An Updated Global Grid Point Surface Air Temperature Anomaly Data
Set: 1851-1990”
The Homogeniety of U.S. station adjustments that appeared in the
1986 Journal of Climate paper was strongly(and rightly) critized
by Wood(Climatic Change/Vol. 12 No. 3-June 1988).
Professor Jones appears afraid of all but a handful of AGW elite.
The scientific community at large has no way of ascertaining
the value of any updated/changed/deleted data!
And we are expected to develop life changing Global Policy?

Just for the record, I don’t think any “confidentiality agreement” with Spain exists. Let me tell you why. The Met Agency in Spain “sells” the data. The web page says:
– Services subject to fees: “The issuance of certificates of weather information available in the archives”
I can’t understand then any mention to a “confidentiality agreement” in the case of Spain. BTW, unfortunately we do not have anything similar to FOIA in Spain.

Forgot to mention in the last post, it “sells” the data to the general public and if it is to be used for commercial purposes. Of course under WMO recommendation is for free for researchers and academic institutions.

In addition to this splendid effort, might I suggest as I did on a previous blog, that after you send your private list you engage your Country’s Ministers (Foreign Affairs, Environment, Science, Technology, Education — whatever) to also submit a request on behalf of your country. Some Ministers will not touch it, but it takes only one to succeed.
I see Tuvalu is still on the list. Better snap it up quick before it vanishes beneath the waves….

I think sending a lot of requests to CRU/Met Office from individuals scattered around the world will achieve little. I suggest that Steve approach the following:
1. Lord Lawson. A former British Chancellor of the Exchequer and active member of the House of Lords who has written a book on economics of climate change.
2. Peter Lilley. A former Conservative Cabinet Minister who was the only MP to warn in a parliamentary debate of the unwarranted costs of mitigating climat change. He is still a Member of Parliament.
3. Christopher Booker. A journalist on the Telegraph newspaper who is a well known sceptic.
4. Professor David Bellamy. A rspected environmentalist and climate chnage sceptic.
They should be asked to submit FoI requests and would have the weight to push the CRU/Met Office.

Isn’t there a risk that the appearance of a concerted campaign can be used as evidence that the requests are “vexatious” which is one of the UK FOI’s exceptions? Especially as the wording is all but identical? Still, that boat has sailed now I suppose.

I think it’s possible they may try this line of defence. However, the inquiries are not really vexatious. We’re just trying to find out which countries these supposed confidentiality agreements apply to. Then we could FOI the rest.
OTOH, if Phil Jones really doesn’t have any records of such agreements… One thing is for sure. David Palmer is not going to appreciate this pile of FOI requests and he will be motivated to resolve the impasse in a way that doesn’t reflect poorly on himself and his office. I expect he’ll kick it upstairs.
Further, if the press get interested, I doubt that the institutions are going to put up with Jones’ precious behaviour much longer.

I have some experience of doing FOI requests, so let me offer some advice:
Under FOI, the request cannot be considered vexatious because it is clearly a genuine request. However, where a series of requesters are clearly acting in concert, the requests can be aggregated – treated as a single request. I’m pretty sure that will be the response in this case.
The Act only requires organisations to spend up to 18 hours on finding the information – looks to me like this collection will take much longer. So expect the answer to be no. On the other hand, they are supposed to offer to advise and assist – in other words, you can ask them how to frame the request so it can be done in less than 18 hours. Why not try a sample of countries? You don’t need all of them.
If that fails, definitely appeal to the Information Commissioner. He is reasonably effective at upholding the law. Just don’t hold your breath – he can take up to a couple of years to report back!
With regard to the information you are looking for under the Environmental Information Regulations, there may not be any formal confidentiality agreement, and there does not have to be. The legal basis is the common law idea that someone can have an expectation of confidence. You don’t have to have a signed agreement with your doctor not to tell anyone about how you got that embarrassing rash – you have every expectation that he will keep it confidential, and you would be entitled to sue for damages if he revealed it. If the information you are requesting has been provided under a reasonable (and legally actionable) expectation of confidence, then no chance – it can be legally withheld. Mind you, it does depend how old it is – confidentiality is usually considered to diminish with time. And if it has been distributed to a substantial number of people – willy nilly to academics, say – that would weaken it as well. There has to be evidence of a formal relationship, not just an attempt to keep the hoi polloi from getting their sweaty fingers on it.
Once again, the Information Commissioner is your friend. Once he gets around to you, that is.
Having supported litigation and worked with lawyers, I would expect that they would be very interested in this part of the answer:
They would have a motion asking the judge to construe the word non-academic. Evidently some data has been released to the Met Office. The Met Office is not an academic institution. It does not teach and it does not grant degrees. Evidently academic extends beyond degree granting schools. A strong argument could be made that it included non-commercial research as evidenced by the supply of data to the Met Office.
Hs this data been supplied to similar institutions – NOAA, national labs in the US, CSIRO, Canadian NRC etc.?

I assume that the reference number means that this is the 100th email Palmer has received! This will presumeably totally foul up his plans for a vacation.

CRU response fails to comply with rule 12 (11).
I was perusing the Environmental Information Regulations of 2004 at http://www.opsi.gov.uk/si/si2004/20043391.htm#12 and noticed that Rule 12 (11) states
The rejection notice to Steve McIntyre did not explicitly state that the CRU was not reasonably capable of separating out the exempted data from the non-exempted data, and therefore CRU should have supplied the non-exempt data to which the various claimed exemptions did NOT apply.
If the Met Office is using spurious reasons and/or ignoring the statutory public interest test contained in the FoIA and the EIRs then rather than sending what looks not far short of a chain letter the appeal process to the ICO should be used. This is what it is for. In addition, the Met Office should be reported to the relevant Secretary of State for misconduct with a request that disciplinary action be taken against the civil servants responsible.
So find a friendly academic and get him/her to request it?
So there was indeed a campaign of vexatious FOI requests. Thanks for being blatant about it:

Jones could have taken 30 seconds and sent the data requested to Steve by resending the package already sent to Peter Webster. What you drive by commenters always seem to miss is that the original obfuscation led to an escalation, not the other way around.
Another admission of guilt. “They started it” is the same as saying “we did indeed escalate the conflict because we felt we were in the right” and now a man is contemplating suicide and your side has exposed themselves as saboteurs more interested in disruption than science.

Guessing how much time it could have taken someone else to do something other than their jobs, doesn’t impress me much. Even reading your comment takes more than 30 seconds and as long as each new request regards another five nations, and then another, and then another, you have very consciously “escalated” the perceived conflict into exactly the kind of abusive behavior climate conspiracy theorists were already suspected of.

But no, it doesn’t bother me significantly that only one out of the following requests were filled:
FOI_09-44 (Refused), FOI_09-63 (Refused), FOI_09-64 (Refused), FOI_09-65 (Refused), FOI_09-71 (Released), FOI_09-117 (Pending), FOI_09-128 (Pending).
Which ones of these came from McI?
The response to 09-71 would also be interesting, but that request seems to understand the concepts of privacy…
